You cannot agree with your neighbor on the boundary line? Or you want to build a garage exactly on the border? Then you can have your property boundary officially determined.
The boundary determination survey serves the purpose of legal certainty and thus a permanent safeguarding of the ownership of the land and the preservation of boundary peace.
The location of the boundaries of your property is documented in the real estate cadastre. With the help of this proof, the course of the boundary is precisely determined on site by a surveyor and permanently marked with boundary signs, such as boundary stones, plastic marks, chisel crosses or similar. Deviations from existing boundary installations, such as fences, are documented. You and all involved neighbors will be invited to an appointment on site. There, all parties involved will be informed about the result of the boundary determination and demarcation. The result of the boundary determination and demarcation is recorded in a document. This document has evidentiary value in court. Upon request, you will receive a copy of this document.
The (written) application for surveying can be made by the owner of the land. The application must state who will pay the fees for the survey.
Note: Boundary markers, also called "Abmarkungen", are under special legal protection. Anyone who deliberately removes or changes them is liable to prosecution.
- The property concerned is located in the municipality of Bremerhaven.
- Eligible to apply are owners, heritable building owners or authorized representatives of one of the properties adjacent to the boundary to be determined.
- Written application (also possible via internet, e-mail or fax) by the applicant.
- Coordination of the measurement date by the surveying and cadastral office.
- Execution of the local measurement and notification of the date on site, possibly with a time delay.
The employees of the Surveying and Cadastral Office first check on site whether the boundary signs of the boundary to be determined are locally present. Missing boundary signs are newly set (marked off).
In the process, the employees of the surveying and cadastral office are authorized to enter or drive on neighboring properties.
At the end of the survey, a record of the boundary appointment is made. The persons affected by the surveying (participants) are summoned in time to the appointment in writing or by telephone. The invited persons may be represented by a written power of attorney. - Announcement to all parties not present by sending a copy of the document.
- Transfer of the surveying results into the real estate cadastre
- Sending of the notice of costs, in case of changes in the real estate cadastre sending of the change notices.
- After approx. 7 weeks after receipt of the application, the survey is transferred to the real estate cadastre and the cost notification is sent to the party liable to pay the costs.
Indication of the parcels concerned: Naming of street and house number or cadastral designation, i.e. parcel and parcel number.
