If you apply for a preliminary decision on a plant requiring a permit, the competent authority may grant this under certain conditions.
When you apply for a preliminary decision, the competent authority decides on individual licensing requirements and on the location of the plant.
Provided that the effects of the planned plant can be sufficiently assessed and there is a justified interest in issuing a preliminary decision, the competent authority shall issue a preliminary decision.

The preliminary decision becomes invalid if you do not apply for approval of the plant within two years. In justified exceptional cases, the period of validity of the preliminary decision can be extended by up to two further years.
